1. Who We Are

OmniBuys LLC, a Florida limited liability company doing business as "Scaling With Systems" ("we," "us," "our," or the "Company"), operates www.scalingwithsystems.com and related properties (the "Site") and provides sales and marketing education, coaching, and done-with-you implementation services (the "Services").

This Privacy Policy explains what personal information we collect about you, how we use and share it, and the rights and choices you have. It applies to visitors and clients worldwide.

2. Information We Collect

Information you provide to us

  • Contact and identity data: name, email address, phone number, country, time zone.
  • Business qualification data: company name, industry, monthly revenue range, primary offer, marketing channels, self-reported constraints, and answers to application questions you complete when booking a call.
  • Scheduling data: the date and time you select for a call, and any meeting notes we take with you.
  • Payment data: billing name, billing address, and payment method details. Card numbers are processed by our payment processors (e.g., Stripe) and are not stored on our servers.
  • Communications: the content of emails, text messages, Slack messages, form submissions, and call recordings you exchange with us.
  • Content you submit: creative assets, ad copy drafts, sales-call recordings, CRM exports, ad-account attribution reports, and any other materials you share as part of the Services.

Information collected automatically

  • Device and log data: IP address, browser type and version, operating system, device type, language, referring URL, pages viewed, links clicked, time and duration of visits.
  • Cookies and similar technologies: first- and third-party cookies, pixels, web beacons, local storage, and session identifiers. See Section 8 (Cookies & Tracking Technologies).
  • Advertising identifiers: event data associated with the Meta (Facebook) Pixel, Hyros tracking, YouTube/Google conversion tags, and similar tools when you interact with our Site or ads.

Information from third parties

  • Ad platforms: Meta, Google, YouTube, TikTok, and similar advertising platforms may share aggregated or hashed information about how you interacted with our ads.
  • Enrichment providers: we may look up publicly available business information (company size, website, LinkedIn) to help qualify leads.
  • Payment processors: we receive transaction status and limited billing metadata (last four digits, card brand, country) from Stripe, JPMorgan Chase, and similar processors.

3. How We Use Your Information

We use your personal information for the following purposes, and only where we have a lawful basis to do so:

  • To provide and operate the Services — deliver strategy calls, onboarding, done-with-you implementation, Slack support, and account management (legal basis: performance of a contract).
  • To qualify prospects — evaluate your responses to application questions and decide whether the Services are a fit before scheduling a call (legal basis: pre-contractual steps at your request; legitimate interests).
  • To communicate with you — send transactional emails and text messages (call confirmations, reminders, receipts, onboarding instructions), respond to inquiries, and provide customer support (performance of a contract; legitimate interests).
  • To send marketing communications — send educational content, offers, event invitations, and case studies by email or SMS where you have consented or where we are permitted to do so under CAN-SPAM, TCPA, and applicable laws (consent; legitimate interests).
  • To personalize the Site and ads — measure the effectiveness of our marketing, retarget you with ads on Meta / Google / YouTube, and improve the content we show (consent, where required; legitimate interests).
  • To analyze and improve — understand how visitors use the Site, diagnose technical issues, and improve our funnels and content (legitimate interests).
  • To comply with law — meet tax, accounting, dispute-resolution, and other legal obligations (legal obligation).
  • To protect our rights — investigate fraud, enforce our Terms of Service, and defend against legal claims (legitimate interests).

4. Phone Calls, Text Messages & TCPA Consent

When you submit a booking form, application, or contact form and provide your phone number, you expressly consent to receive calls (including from an automated dialing system or with a prerecorded/artificial voice) and text messages (SMS/MMS) from OmniBuys LLC and its agents at that phone number, related to your inquiry, your application, your appointment, the Services, and marketing communications. Consent is not a condition of purchase.

Message and data rates may apply. Message frequency varies. You may reply STOP to any text message to opt out at any time, or HELP for help. You may also opt out of marketing calls or emails by contacting support@scalingwithsystems.com. Opting out of marketing does not affect transactional messages related to an active engagement.

5. Sharing Your Information

We do not sell your personal information for money. We share information only as described below:

  • Service providers that process data on our behalf under written agreements, including: hosting (Netlify), email (Google Workspace, transactional email providers), calendaring (Calendly), messaging (Slack, SMS providers), analytics (Google Analytics), advertising measurement (Meta Pixel, Hyros, Google Ads), payment processing (Stripe, JPMorgan Chase), CRM, and document signing.
  • Advertising partners — we share hashed event data (such as email address, phone number, page views, purchases) with Meta, Google, YouTube, TikTok, and similar platforms so we can measure the performance of our ads and show relevant ads to you and to lookalike audiences. Where required by law (e.g., in the EU/UK, California), this sharing is treated as "sharing for cross-context behavioral advertising" or "targeted advertising" and you can opt out (see Section 9).
  • Professional advisors — accountants, lawyers, insurers, and auditors.
  • In corporate transactions — if we merge, are acquired, or sell substantially all of our assets, your information may be transferred to the successor entity.
  • To comply with law — where required by subpoena, court order, or applicable law, or to protect rights, property, or safety.
  • With your consent — for any other purpose you approve.

6. International Transfers

We are based in the United States. If you access the Services from the European Economic Area, United Kingdom, Switzerland, Canada, Australia, or elsewhere outside the U.S., your information will be transferred to, stored, and processed in the U.S., which may not offer the same level of data protection as your home country.

Where required by law, we rely on appropriate safeguards for international transfers, including the European Commission's Standard Contractual Clauses (SCCs) and the UK International Data Transfer Addendum. You may request a copy by emailing support@scalingwithsystems.com.

7. Data Retention

We keep personal information for as long as necessary to provide the Services, comply with our legal obligations (including tax, accounting, and dispute-resolution requirements — generally up to 7 years for financial records), resolve disputes, and enforce our agreements.

Prospect and lead data that does not become a client is generally retained for up to 24 months for follow-up and re-marketing, unless you ask us to delete it sooner. Call recordings are retained for the duration of the client engagement and up to 24 months after termination.

8. Cookies & Tracking Technologies

We and our advertising partners use cookies, pixels, tags, and similar technologies. Categories include:

  • Strictly necessary — required for the Site to function (session, security, load balancing). Cannot be disabled.
  • Analytics — Google Analytics and similar tools help us understand aggregate traffic patterns.
  • Advertising / retargeting — Meta Pixel, Hyros, Google Ads, YouTube conversion tags allow us to measure ad performance and show you relevant ads on other platforms.

You can control cookies through your browser settings and opt out of interest-based advertising via DAA, NAI, or Your Online Choices (EU). Meta ad preferences can be adjusted at facebook.com/ads/preferences.

9. Your Rights and Choices

All users

  • Access, correct, or delete personal information we hold about you.
  • Opt out of marketing emails (use the unsubscribe link in any marketing email) and text messages (reply STOP).
  • Withdraw consent where we rely on consent as our legal basis.

European Economic Area, United Kingdom & Switzerland (GDPR / UK GDPR)

You have the right to: access your data; request rectification or erasure; restrict or object to processing; data portability; and lodge a complaint with your local supervisory authority. Where we rely on legitimate interests, you may object at any time by contacting support@scalingwithsystems.com.

California residents (CCPA / CPRA)

You have the right to know what personal information we collect, use, disclose, and "share" (as defined by California law); the right to delete personal information; the right to correct inaccurate information; the right to opt out of sharing for cross-context behavioral advertising; and the right to non-discrimination for exercising these rights. To exercise these rights, email support@scalingwithsystems.com with the subject line "California Privacy Request." We do not knowingly sell personal information in exchange for money. In the last 12 months we have "shared" the following categories for cross-context behavioral advertising: identifiers (name, email, phone), internet activity (page views, clicks), and inferences derived from the foregoing, with advertising platforms including Meta and Google.

Other U.S. states (Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and similar)

You have rights to access, correct, delete, and receive a portable copy of your personal data, and to opt out of targeted advertising, sale of personal data, and profiling with legal effects. Submit requests to support@scalingwithsystems.com.

Canada (PIPEDA) and Australia (Privacy Act)

You have rights to access and correct personal information and to make a complaint. Contact us at support@scalingwithsystems.com.

We will verify your identity before responding to rights requests and will reply within the timeframes required by applicable law (generally 30–45 days). Authorized agents may submit requests on your behalf with proof of authority.

10. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

11. Children's Privacy

The Services are directed to businesses and individuals aged 18 or older. We do not knowingly collect personal information from children under 16. If we learn we have collected information from a child under 16 without verified parental consent, we will delete it.

12. Third-Party Links

The Site may link to third-party websites and services (case study client sites, YouTube, calendar tools, social platforms). We are not responsible for the privacy practices of those third parties. Please review their privacy notices.

13. Do Not Track

We do not currently respond to "Do Not Track" browser signals because there is no industry-standard interpretation. We do honor Global Privacy Control (GPC) signals as an opt-out of sale/sharing where required by law.

14. Changes to this Policy

We may update this Privacy Policy from time to time. Material changes will be posted here with a revised "Last updated" date, and we may notify you by email or an on-site notice. Your continued use of the Site or Services after changes take effect constitutes acceptance of the updated policy.
