DMCA Copyright Policy

1. Overview

OmniBuys LLC, a Florida limited liability company doing business as "Scaling With Systems" ("OmniBuys," "we," or "us"), respects the intellectual-property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the "DMCA"), we will respond promptly to properly formatted notices of alleged copyright infringement.

This policy explains how to submit a takedown notice, how to submit a counter-notice, and our policy for repeat infringers.

To be effective, notices must be sent to the designated agent above. Notices sent to other addresses may not be acted upon.

3. Notice of Alleged Infringement (Takedown Notice)

If you believe that content on our Site infringes a copyright you own or control, please send a written notice that includes all of the following (as required by 17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or the subject of infringing activity and information reasonably sufficient to permit us to locate the material (e.g., the exact URL);
  4. Information reasonably sufficient to permit us to contact you, such as your full name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Please be aware that if you knowingly materially misrepresent that any activity or material is infringing, you may be liable for damages (including costs and attorneys' fees) under 17 U.S.C. § 512(f).

4. Our Response

Upon receipt of a properly formatted notice, we will investigate and, in our discretion, may (a) remove or disable access to the allegedly infringing material, (b) notify the person who posted the material, and (c) take further action as we deem appropriate. We may also forward the notice to the person who posted the material.

5. Counter-Notice

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notice to our designated agent that includes all of the following (as required by 17 U.S.C. § 512(g)(3)):

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or disabled and the location at which it appeared before removal or disablement;
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your full name, mailing address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the U.S. District Court for the Southern District of Florida), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notice, we will forward it to the complaining party. Unless the complaining party notifies us that they have filed an action seeking a court order to restrain the user, we may restore the removed material in 10 to 14 business days.

6. Repeat Infringer Policy

We will terminate, in appropriate circumstances, the accounts, access, or services of users who are repeat infringers. We may also, in our discretion, limit access to the Site or Services for any user who infringes any intellectual-property rights of others, whether or not that constitutes repeated infringement.

7. Trademark, Right of Publicity & Other Claims

This DMCA policy applies only to copyright complaints. For trademark disputes, right-of-publicity claims, defamation claims, or other non-copyright complaints, please contact us at support@scalingwithsystems.com with a detailed description of the issue and your good-faith basis for the claim.

8. Changes to this Policy

We may update this DMCA Policy from time to time. Material changes will be posted here with a revised "Last updated" date.
